1.  GENERAL TERMS

AGREEMENT BETWEEN USER AND SUPERIOR KITCHEN & MORE DBA CABINETRYSOLUTION.COM  - PLEASE READ

The following terms and conditions (the "Terms") govern your access to and use of this website (www.cabinetrysolution.com)

("the Site"). These Terms constitute a legally binding agreement between you and CabinetrySolution.com. By accessing or using the Site, including any purchases of cabinets, countertops, services, or related materials, you agree to comply with these Terms. If you do not agree to any part of these Terms, please discontinue use of the Site and any services provided through it.

Superior Kitchen & More, Inc, operating as CabinetrySolution.com (hereafter referred to as "CabinetrySolution.com", "we", "us", or "our"), offers users ("you" or "the User") access to a range of resources, content, e-commerce features, and related services through our website and platform (collectively, "the Service"). Your use of the Service is subject to these Terms of Service.

These Terms override any other information or representations provided by a CabinetrySolution.com representative, whether given verbally, in writing, or by third parties such as shipping providers or countertop fabricators/installers, unless expressly approved in writing by CabinetrySolution.com management.

The Site and our Services are available to individuals who are 18 years or older and reside within the continental United States, which includes the 48 contiguous states but excludes Alaska and Hawaii. If you are under 18 or reside outside the continental United States, please refrain from using this Site. If you are outside the continental U.S., you will be responsible for arranging shipping outside the country. By using the Site, you confirm your agreement to these Terms.

Any disputes arising from the use of this Site or our Services will be resolved through arbitration, as outlined in the arbitration and class action waiver provisions detailed below.

  MODIFICATION OF THESE TERMS OF USE

We reserve the right to modify, update, or change any of the terms, conditions, and notices under which the Services are provided. It is your responsibility to periodically review these Terms, including any updates or modifications made by us. Your continued use of the Services after any changes have been posted constitutes your acceptance of the updated Terms and conditions.

  MODIFICATION TO THE SERVICE

We reserve the right to modify or suspend the Service, in whole or in part, either temporarily or permanently, with or without prior notice to you at any time. You acknowledge and agree that we shall not be liable to you or any third party for any such modification, suspension, or discontinuation of the Service. In certain cases, changes or interruptions in the Service may occur due to the unavailability of external suppliers or resources.

  TAXES

We will automatically apply and collect the required sales tax for all orders. Customers who qualify for tax exemption must provide valid proof of exemption and will be solely responsible for any sales or other taxes if not properly documented.

Tax Exemption or Resale Certificates should be submitted via email to CabinetrySolution.com at

with the subject line: "Tax Exemption or Resale Certificates."

Once the exemption is verified and confirmed by our team, applicable taxes will be removed from future purchases.

  TIMING AND DELAYS OF ORDERS DO NOT PROVIDE ADDITIONAL RIGHTS FOR PURCHASER 

  TO CANCEL, MODIFY, AND OR RETURN AN ORDER.

All cabinetry, countertops, and related products are obtained from various third-party suppliers and locations. We do not guarantee shipment times or delivery dates for any products and are not liable for any delays or complications that may impact the overall project timeline. For example, if you order both cabinets and a countertop, the countertop installation cannot proceed until the cabinets are properly installed. In cases where a cabinet arrives damaged and requires replacement, it will not affect the production or shipment of the countertop, although it may delay its installation. This policy applies regardless of whether the products are part of the same order or separate orders.

2.  TERMS RELATED TO CABINET ORDERS

  PURCHASES

ALL SALES ARE FINAL. During checkout, you are required to carefully review your order for accuracy. By completing your purchase, you acknowledge that if you have selected Ready To Assemble (RTA) cabinets, they will be shipped unassembled, and all part numbers reflect the items you intended to purchase. Only items specifically labeled as "assembled" will arrive pre-assembled; all other products are shipped unassembled unless otherwise noted. Please note that the cabinet style names used by CabinetrySolution.com are marketing designations, and the packaging may display different style names assigned by the manufacturer.

  • We strongly recommend ordering sample materials. Please note that color variations can occur due to differences in monitor displays, settings, and lighting conditions. CabinetrySolution.com advises customers to order door samples before placing a full cabinetry order to verify the appearance in the lighting conditions of the installation area. Sample materials, including cabinet samples, may be purchased to test the color and material. If you proceed with purchasing full cabinetry from us, the cost of up to four samples per order can be credited toward the total purchase price.

  • Cabinet Specifications: It is your responsibility to ensure you have the necessary knowledge and information to make informed purchasing decisions on the Site. You must carefully review the specifications of each item and verify that they meet your needs and intended use. We highly recommend hiring a professional to assist in confirming the dimensions and fit of the cabinetry you are ordering. While our team of designers can assist with quotes and designs, customers are free to request changes to their order. CabinetrySolution.com.  provides suggestions based on the information you provide, but the final responsibility for verifying the accuracy of all suggestions and designs rests with you. Please confirm all details before placing your order, as you bear the ultimate responsibility for the products being ordered. Any designs provided by CabinetrySolution.com are intended solely to facilitate discussion and visualize potential ideas. We do not guarantee that any quote or order will precisely correspond to any pre-order design. We will ship the items based on the final design and order details.

  • Code/Permits: You are solely responsible for ensuring that the cabinet design and installation comply with your local and state code requirements and for obtaining any necessary permits. CabinetrySolution.com disclaims all responsibility for code and permit compliance and will not be held liable for any issues in this regard. Any design assistance provided by CabinetrySolution.com is intended purely as creative inspiration and suggestions on sizing and relative positioning of cabinets, not as a guarantee of compliance with regulatory requirements.

  CANCELLATION of ORDERS

  • Orders that are eligible for cancellation before being processed for shipment, including those with incomplete payments (e.g., wire transfer sales), will incur a 10% cancellation fee.

  • For orders cancelled after processing or once the items have been picked and/or shipped, a 20% restocking fee will apply, in addition to any freight costs incurred for returning the item(s) to the warehouse.

  • Orders for assembled cabinets, special orders, and custom orders cannot be cancelled under any circumstances. Full payment will remain due, even if the order is cancelled or the shipment is refused.

 

All custom orders are final and non-cancellable. These custom orders, even when in Ready to Assemble (RTA) form, are fabricated specifically for your order using specialized materials, sizes, and requests.

  DAMAGE CLAIMS:

We are happy to replace products or parts that are found to be defective due to manufacturing or workmanship issues within five (5) days of receipt, provided the issue cannot be resolved onsite. Fulfillment errors on our part, such as the shipment of incorrect or missing items, must also be reported within five (5) days of receiving the products.

Do NOT refuse any shipments. If products are damaged during shipping, CabinetrySolution.com will replace them. Shipping companies are not responsible for this type of damage. Any visible damage upon receipt must be noted on the Bill of Lading (BOL) and signed by the driver, who will issue an exception number. We recommend taking photos as soon as possible, ideally before the pallet is unloaded, to document the condition of the entire pallet inside the truck, including any visible damage.

In the event of a damaged product, photos are REQUIRED before a replacement can be issued. Please email the photos to Reply@CabinetrySolution.com with the subject line: "Damage Claims" (include your Order Number).

 

 To submit a claim, please use the Warranty Information Page located in the footer of every page on our website. A Claims Submission Form must be completed and submitted in order to receive replacement parts. This form should be submitted upon receipt of the order and prior to assembly. Please note that only one damage claim per shipment will be accepted. It is important to inspect all items upon delivery before filing a claim.

Multiple claims for the same shipment will not be accepted unless prior approval is obtained from CabinetrySolution.com. Under approved damage claims, CabinetrySolution.com will replace damaged parts, not entire items, including for assembled orders. For approved damage claims involving scratches, nicks, or dings to side panels of cabinets (including exposed sides), CabinetrySolution.com may provide appropriate skins or panels to cover the affected areas at its discretion.

  • Damage claims cannot be processed for cabinets that have already been assembled.

  • Claims can be submitted for replacement items only.

  • We do not offer financial compensation, including partial or full refunds, for any claims, delays, or issues. This policy applies even if a damaged product is assembled instead of filing a claim for replacement parts. All claims will be handled as described above.

  • Shipping Damage Claims: Any visible damage to the shipping boxes must be reported within 5 days of receipt.

  • Concealed Damage and Defects Claims: Any damage or defects not visible upon initial receipt must be reported within 30 days of receipt.

 Concealed Damage: Concealed damage refers to any damage not visible from the outside of the shipping container or box, such as scratches, dings, gouges, or warping of doors. Please note that non-visible parts of cabinets and trim (e.g., backs of cabinets, molding, toe kicks) may not be finished to the same standard as visible parts. Details regarding the main finish and other specifications of the products are available on each style page. Unfinished or differently finished non-visible items are not considered damaged simply because they are concealed or covered after installation (e.g., a scratch on a cabinet side hidden by an adjacent cabinet or panel).

Missing Items: Any missing items, including complete cabinets or parts such as hinges, screws, or brackets, must be reported within 5 days of receipt.

WE STRONGLY RECOMMED verifying that all ordered materials are present at the time of delivery. You will be required to sign a confirmation form from the shipping company that acknowledges receipt of the goods.

 

Damaged, defective materials, or missing items cannot be replaced without prior approval from CabinetrySolution.com.

  • Replacement parts and cabinets may have a lead time similar to that of a new order. While we strive to replace defective items as swiftly as possible, we cannot guarantee a specific replacement date. This is due to potential stock availability issues with our warehouses. To expedite the process, please complete the claim form promptly.

  RETURNS

 

Returns: Returns are not accepted for orders or items beyond 30 days from the date of receipt. All returns must be authorized by CabinetrySolution.com before shipping the items back. To request authorization, please email Reply@CabinetrySolution.com

All items must be returned in original packaging in a resalable condition. Therefore:

  • Assembled Cabinets: Returns are not accepted for assembled cabinets.

  • Modified Cabinets: Returns are not accepted for cabinets that have been modified.

  • Custom Orders: Returns are not accepted for custom orders.

  • Hoods, Trims, Moldings, Fillers, Panels: Returns are not accepted for these items.

  • Accessories: Returns are not accepted for accessories such as trash pull-outs, spice pull-outs, glide upgrades, etc.

    You are responsible for the cost of all return shipments. 

Credit Issuance: Credit will be issued once returned items have been received and inspected at our warehouse. Please note that any returned products deemed unsellable WILL NOT RECEIVE CREDIT.

Important Note: The Cancellation and Return Policies outlined above apply uniformly, regardless of the reason for the return. The damage claim process at CabinetrySolution.com focuses on providing replacement parts when applicable. Returns will be subject to applicable shipping, restocking, or cancellation fees as outlined, and are subject to time limitations. If you have any questions about returns versus the replacement of damaged products, please contact us for clarification.

  CUSTOMER(S) RESPONSIBILITY

Inspection and Reporting: It is the customer’s responsibility to inspect all items upon delivery to ensure there is no visible damage and that all ordered items have been received. CabinetrySolution.com will not be liable for any missing or damaged items if you sign for your order without noting discrepancies. Any issues must be reported through a completed claims form on our website. Failure to properly inspect and report damage may forfeit your ability to return or exchange items.

Assembly and Installation: Customers are responsible for assembling cabinets or hiring a professional to do so. This excludes pre-assembled items, which are covered only under the Purchases section described above. CabinetrySolution.com does not cover costs for assembly or installation, though we may provide general suggestions. Additional time for consultation may incur separate fees.

Assembly Videos: Assembly videos available on our website are intended for general guidance and may not apply to every cabinet style. We recommend scheduling a free 1-hour consultation with us or consulting with a professional installer before starting your installation.

Coordination with Vendors: Customers are responsible for coordinating work with external vendors and may experience delays due to back orders, damage claims, or schedule changes. We advise ordering cabinets well in advance of critical deadlines to mitigate potential delays.

Countertop Measuring: To avoid conflicts, CabinetrySolution.com recommends scheduling countertop measuring and templating only after cabinet installation is complete.

Additional Charges: CabinetrySolution.com is not liable for any additional charges incurred by independent contractors for their work, nor for any additional charges passed on to retail customers.

Delivery Accessibility: Customers must ensure that their delivery location is accessible. Shipping companies may refuse delivery if the address is on a dead-end street, narrow entryway, or otherwise restricted. In such cases, you may need to arrange for “final mile” delivery or pickup at shipping terminals. Contact us prior to placing an order to discuss delivery constraints, such as gated communities or narrow roads, to facilitate accommodation. Additional charges may apply for changes to standard truck sizes.​

Delivery Refusal: If the delivery cannot be completed due to accessibility issues and you choose to cancel or return the order, YOU WILL BE RESPONSIBLE FOR RETURN FEES and RESTOCKING COSTS.

​  SHIPPING POLICY​​​

   Order Processing and Shipping: Orders are processed in the sequence they are received. Due to product availability and shipping schedules, it may take several weeks or even months for an order to be shipped after placement. It is the customer’s responsibility to inspect all items upon delivery to ensure there is no visible damage and that all items ordered have been received.

 Shipping Estimates: All shipping times provided are estimates. As we rely on third-party shipping companies, we cannot guarantee exact delivery dates. Shipping or transit times given by CabinetrySolution.com or other parties should be considered as approximations only. Orders may arrive earlier or later than the estimated delivery date.

Special Delivery Requirements: If you have specific delivery requirements, please contact CabinetrySolution.com before placing your order so we can make every effort to accommodate them. We recommend placing orders well in advance to minimize potential delays related to shipping or product availability.

Delivery Scheduling: The delivery company will contact you using the phone number provided with your order to schedule a delivery window, which may be a few hours or up to a full day. You must be available on the scheduled day to inspect and accept the shipment. The delivery driver will also call on the day of delivery before arriving. CabinetrySolution.com uses third-party shipping companies and is not responsible for any additional costs incurred due to missed appointments or delays, including costs related to multiple delivery attempts.

Out-of-Stock Products: Occasionally, products may be out of stock, which could delay order fulfillment. This may occur even if our website does not indicate an item is out of stock, as the site is updated frequently but does not reflect live inventory. We will keep you informed about any items that are out of stock and unavailable for shipment within the estimated shipping time provided.

Back-Order and Out-of-Stock Products: If an ordered product is on back-order or out of stock and this was not indicated on the website at the time of order, you will have the option to either select alternative in-stock items (with any applicable price difference payable) or to receive the available items first and have the remaining items shipped when they become available. Please refer to the shipping disclosure below for information on associated costs.

Shipping for Large Orders: Shipments over 50 lbs. will be delivered via pallet and semi-trailer. For residential deliveries, the driver is responsible only for lowering the pallet to the curb. It is your responsibility to move or unload the pallet from that point. Shipping companies may refuse deliveries or impose additional fees based on local conditions, including but not limited to accessibility, safety, and secure offloading. The shipping company's decisions on these conditions are final, and you will be liable for any additional fees charged by the shipping company. Note that shipping companies will not unload the pallet for the customer. We at CabinetrySolution.com recommend removing the shrink wrap from the pallet and then unpacking individual boxes as needed.

Special Shipments: Orders exceeding 50lbs or large materials such as refrigerator panels or finished plywood require Freight Service due to damage risks.

Address and Shipment Changes: Once an order is placed, no changes can be made to the shipment type or delivery address. Any attempt to alter the delivery address with freight dispatch, missed delivery appointments, or specifying a residential address as a business will result in the shipment being returned to the warehouse. THIS WILL INCUR A 20%

RESTOCKING FEE, return freight charges, and an administrative fee before any refund is issued. Ensure that the delivery address is correct and accurately described as either business or residential to avoid return fees.

Free Shipping: Orders with a subtotal greater than $2,400 (pre-taxes and fees) qualify for free shipping to the contiguous 48 states. For back-ordered items, shipping is free if each separate shipment meets the $2,400 minimum. If any part of the order is less than $2,400, shipping costs will be shown at checkout.

Address Verification: VERIFY THE DELIVERY ADDRESS and type before completing your order to prevent return to the warehouse. Only one delivery attempt will be made. Missed appointments will result in the order being returned to the warehouse with applicable return fees.

One attempt will be made to deliver your order.  If a delivery appointment is missed, your order will be returned to the warehouse and all return fees will apply.

   Note: A business located in a residential neighborhood is considered Residential.

SHIPPING DISCLAIMER—PLEASE READ: CabinetrySolution.com is not responsible for missed appointments, delivery delays, etc. and is not liable for additional costs associated with these delays.  CabinitrySolution.com works very closely with the shipping companies to try to ensure that every delivery goes as planned. However, it is impossible to guarantee a delivery date due to the possibility of unforeseen occurrences.  If you have a concern about your delayed delivery, missed appointment, or anything else pertaining to the actual transportation of goods purchased through CabinetrySolution.com, please contact the shipping company directly. CabinetrySolution.com uses third party shipping companies to deliver all goods purchased. CabinetrySolution.com is not in any way affiliated with such shipping companies. Customer understands and agrees that any claims for any type of damage or injury caused by the shipping companies while delivering goods purchased from CabinetrySolution.com should be directed solely to the shipping company or third-party contractor and not to CabinetrySolution.com . This disclaimer waives any responsibility for additional costs on customer’s side (labor for assembly and installation, third party contractors, on site modifications, project delays and associated costs due to damage claims, back orders and other delays, time off from work/income lost for receiving shipments and installing cabinets etc.).

  5-YEAR WARRANTY ON RESIDENTIAL CABINETRY​​​

   At CabinetrySolution.com, we take pride in the durability of our products, which are designed to remain in good working condition for at least five years. That's why we offer a 5-Year Limited Warranty to our customers.

Warranty Coverage: CabinetrySolution.com warrants to the original purchaser that our cabinetry, door hinges, and drawer glides will be free from defects in materials and workmanship under normal use and service for a period of Five (5) years from the date of purchase. Proof of purchase is required for any warranty claims. This warranty is non-transferable and is only applicable to products used for residential purposes.
 

Warranty Limitations: This warranty does not cover:

  • Normal wear and tear

  • Damage or defects caused by accidents, misuse, or abuse

  • Lack of necessary maintenance

  • Alterations, modifications, or improper installations

  • Improper handling or storage

  • Environmental conditions

  • Any labor expenses

Non-Covered Repairs: This warranty does not extend to the replacement of entire cabinetry. Instead, it covers defective parts. CabinetrySolution.com may, at its discretion, choose to repair or replace a functionally equivalent part of any CabinetrySolution.com product covered under this warranty. Replacement parts are subject to availability and may differ from the original parts.  In some cases, defective parts may need to be returned for replacements to be issued. While repair or replacement parts will be covered by CabinetrySolution.com, all other associated costs—such as removal and reinstallation of the product, labor, and related expenses—are the responsibility of the customer.

Natural Wood Characteristics & Finish Disclaimer:

 

Just as no two trees are identical, no two pieces of wood are the same. The natural variations in color and grain patterns are inherent characteristics of wood, contributing to its beauty and uniqueness. These variations are not considered imperfections.

Environmental Impact: Over time, environmental factors such as exposure to artificial or natural light, moisture, cleaning agents, smoke, and other elements may cause the color of the wood to darken or mellow. This is a natural process that can be expected and is not covered under our warranty. Similarly, this warranty does not cover the natural aging, darkening, or mellowing of wood color, or the inherent growth characteristics and variations in wood.

 

Glazed Finishes: Some of our cabinet lines feature a hand-applied glazed finish that enhances the profiles of doors and drawer fronts. Due to the nature of this application process, variations such as random drips, runs, and color differences may occur from one piece to another. These are not defects but are expected variations inherent in the hand-glazing process.

 

Painted Surfaces: Wood naturally expands and contracts based on climate conditions. As a result, painted cabinet lines may develop small fractures in the paint at the joints over time. This is normal and not considered a defect.

 

Warranty Limitation & Claims Process: This warranty is valid only in the United States and is non-transferable. All implied warranties are limited to the longer of the period provided by law or the five-year term of this warranty. To the extent permitted by law, this warranty excludes special, incidental, or consequential damages.

Please note that some states do not allow the exclusion or limitation of incidental or consequential damages, or limitations on the duration of implied warranties. Therefore, the above limitations may not apply to you. This warranty provides you with specific legal rights, and you may also have additional rights that vary from state to state.

How to Submit a Warranty Claim: To exercise this warranty, please contact CabinetrySolution.com Customer Service via email at Reply@CabinetrySolution.com with the subject line: Warranty Claim. Be sure to include your Order Number in your message.

WHAT THIS WARRANTY DOES NOT COVER

Warranty Exclusions & Care Instructions:

    This warranty does not apply to products that:

  • Are installed outdoors.

  • Are used for purposes other than those intended by CabinetrySolution.com.

  • Have been subjected to misuse, vandalism, abuse, negligence, or accidents.

  • Have been improperly stored (Products should be covered and stored in a humidity/temperature-controlled environment, away from direct sunlight).

  • Have been improperly installed, cleaned, or maintained.

  • Have been exposed to improper temperature and humidity extremes (outside the range of 50-85°F for temperature, and 30-55% for humidity).

  • Exhibit normal wear and tear.

  • Were not purchased or installed within the United States.

Natural Wood Characteristics: Natural wood may vary in color and texture, exhibiting subtle changes as it ages. Painted doors, drawer fronts, and solid wood panels may show visible cracking around the joints over time, and cabinet colors may darken or lighten with exposure to sunlight, smoke, and other environmental factors. These natural variations are expected and are not covered under this warranty.

Finish Integrity: Certain household cleaners or substances may affect the color and integrity of the product's finish over time. Such effects are not covered by this warranty.

Cabinet Care: We provide cabinetry care instructions on our Resource Center Page, accessible at the bottom of every page at CabinetrySolution.com. 

3.  TERMS RELATED TO COUNTERTOP ORDERS

  PURCHASES

 All price quotes are valid for 60 days.

We strongly urge ordering sample materials: Color variations occur between different monitors and between different settings as well as a result of lighting conditions. CabinetrySolution.com strongly urges ordering samples before placing an order for countertops to verify appearance in local lighting conditions where countertops will be installed. Sample countertop materials may be purchased to first test the color and material. However, the Product is made up of natural materials which inherently vary in color, shape, size and distribution within each slab. Product samples and slabs may vary from the actual, installed Product surface. In addition, some of the Product colors contain movement or veining and variances due to the randomness of this effect. If you purchase actual countertops from us, the amount paid towards up to 3 samples per countertop order can be applied toward the cost of your order.  

Payments and Pricing: The payment made at the time of purchase is based on the measurements provided by the customer and countertop edge cutouts as selected by the customer prior to order. If the actual surface size needed proves to be larger at time of templating, alterations in selected edge cutouts occur, or other changes increasing the cost are made, a payment for the price difference is due before fabrication and installation can be completed. If such payment is not made within a week of templating, CabinetrySolution.com reserves the right to consider the order cancelled and will refund the full purchase price less the cancellation fee charged for cancellations on or before template date as outlined below.

Countertop Specifications: You must have the necessary knowledge and information to make a purchase on the Site as well as have reviewed the specifications of each item and verified the applicability for your needs and intended use. IF YOU OPT NOT TO TAKE ADVANTAGE OF OUR INSTALLATION SERVICES, WE RECOMMEND HIRING A PROFESSIONAL TO WORK WITH YOU IN CONFIRMING THE DIMENSIONS OF THE COUNTERTOP YOU ARE ORDERING.

Code/Permits: You are responsible for ensuring that the countertop design and placement is up to your local/state code requirements and that you obtain any necessary permits for the project. CabinetrySolution.com disclaims all responsibility and shall not be liable for code and permitting compliance. Any designs that CabinetrySolution.com may assist in preparing is solely for the purpose of sharing creative inspiration and guidance on sizing and relative position of the countertop to other fixtures.

CANCELLATION of ORDERS / REFUNDS:

Countertop cancellation on or before template date – 90% refund (we retain 10%)

Countertop cancellation after templating, but before fabrication is completed – 50% refund

Countertop cancellation after completed fabrication but prior to installation – 15% refund (we retain 85%)

No returns/refunds on installed countertops.

CUSTOMERS RESPONSIBILITY

Customer is responsible for coordinating work with outside vendors and understands there may be delays. CabinetrySolution.com is not responsible for project delays or any additional costs associated with these due to back orders, damage claims, schedule delays, etc.  CabinetrySolution.com recommends ordering countertops well in advance of any critical deadlines in order to alleviate time constraints that may be caused by one of the aforementioned situations.

Customer is responsible for ensuring accessibility delivery and installation. Please reach out to us before placing an order to discuss any potential limitations on delivery and installation.

Customer shall thoroughly inspect the Product upon receipt and prior to permanent installation

TEMPLATE AND INSTALLATION FUNDAMENTALS

Templating can be scheduled and take place within approximately two (2) weeks from placing a countertop order. All timeframes are estimates and may occur sooner or later than that. DO NOT SCHEDULE THE TEMPLATING UNTIL ALL CABINETRY (OTHER THAN CABINETRY RESTING ON TOP OF THE COUNTERTOPS, WHICH MUST BE INSTALLED AFTER THE INSTALLATION OF THE COUNTERTOP) IS INSTALLED AND APPLIANCE MEASUREMENTS ARE KNOWN OR  PRESENT. If you have specific days that you cannot be available, please reach out to CabinetrySolution.com when placing your original order.

 

All required products and/or information (e.g. sink selection, if not included with the countertop, cooktop/rage, or other cut-out items) must be available at the time of template. If all required products and/or information are not available at template, the office of CabinetrySolution.com will be notified immediately. As a result, another template date will be scheduled. This will delay the fabrication and installation of the customer's job, and could result in additional charges.

 

Countertops are generally installed within 14 business days from the date of template provided all required information and/or products are available during the customer's scheduled template appointment. Installation times can be extended during periods of high product volume.

 

Countertop template/installation will be completed between the regular business hours of 8AM - 5PM, Monday through Friday, excluding holidays. The customer or a dedicated decision maker (18 years or older) must be present at all times during the template and installation process.  Once countertop confirmation has been made, at the time of template, no further changes can be made without incurring a restocking fee.

 

   

    ADEQUATE SUPPORT

 

       The surface type and material thickness can dictate the amount of overhang permitted on a countertop. The countertop

       can support an overhang of:

           10”overhang (3cm Stone Countertop thickness)

 

without additional brackets or corbels. However, at least 80% of the total countertop must be supported by cabinets, an island, knee wall, etc. All overhangs in excess of those previously mentioned will require corbels or brackets. All support brackets and corbels must be installed prior to the field template. New or existing cabinets must be structurally sound to withstand the weight of the countertop or with sufficient backing. 

    KITCHEN CABINETS

  • Kitchen cabinets must be square, level, plumb, and secured to the walls and/or floor.

  • The countertop must lie flat within 118” to eliminate stress on the corners, cut-outs, and seams.

  • It is the responsibility of the customer to ensure cabinets are square, level, and plumb.

  • All cabinetry and end panels must be completely and permanently installed (set and level) prior to the date countertops are scheduled to be field templated. Cabinets resting on top of the countertop (e.g. appliance garage, etc.) must be installed after the installation of the countertop.

  • Absolutely no cabinet installation, electrical, or plumbing work is to completed or scheduled during the installation of countertops and or backsplash. 

  • Some holes or cuts may need to be done onsite i.e., faucet, soap dispenser, push buttons, pop-ups, electrical outlets, ect.

    COUNTERTOP and BACKSPLASH SEAMS

         Seam placement is at the discretion of the Certified Fabricator/Installer. Quartz, Granite and Solid Surface countertops will

         have visible seams. Solid Surface countertops will have inconspicuous seams. Although Installer will match color to the

         best of their ability for a less notable seam.

    COLORS ON COUNTERTOPS

         Dark color countertops require more maintenance and cleaning. Under everyday use, darker colors will show dirt, dust,

         rubs, fingerprints, scratches, and watermarks easier than lighter color patterns.

         White colors granite countertops can be difficult to keep clean. Every spec of dirt is made more visible on a white surface. It

         takes work to maintain its fresh appeal, which means you have to keep your hands on it. Granite countertops are sealed

         to prevent stains and bacterial growth, as well as increase longevity. The frequency of sealing depends on how frequently

         you use your countertops. Typically, maintenance should be scheduled every 1-5 years. While not something to worry

         about every day, it does need to be done to prevent etching and signs of wear and tear. Granite countertop materials may

         contain iron, which can rust over time in a high-moisture environment. White Quarts color my fade or yellow with direct

         sunlight within time.

    TEAR-OUT / INSTALLATIONS

  • Incidental Damage — Final wall preparations (e.g. painting, wall papering, etc.) should not be completed prior to installation if at all possible. Care will be exercised during the countertop installation; however, scrapes, punctures or dings to wall surfaces are possible, as are scratches and scrapes to cabinetry, and in some cases necessary due to the exact fit or precision of the countertop. These items are considered incidental damage and are the customer's responsibility to repair. In most instances, cabinets can be easily repaired with a cabinet touch-up kit.

  • Pathway — During the installation process it’s possible that the third party Certified Fabricator/Installer will make a number of visits from their outside work area to the kitchen. As a result, please communicate a pathway you want the Certified Fabricator/Installer to use. Please note the pathway should be sufficient size since they will be carrying large countertop pieces and cannot carry these items through tight areas.

  • Dust — Installation of a countertop is a construction process and residual dust should be expected. The customer may want to drape or cover areas to help contain the dust to the construction area. The job site will be left in broom-clean condition.

  • Electrical/Plumbing — Please contact a licensed electrician or plumber prior to installation should you need any electrical or plumbing work done.

  • Removal of Personal Items — Prior to tear-out/installation, please remove all items on top of the countertops, and all items in the lower portion of countertop cabinets. The Certified Fabricator/Installer may also ask the customer to remove any additional items that may impede tear-out and/or installation.

  • Sink Temporarily Out of Service — The customer should discuss the use of sinks and appliances with the Certified Fabricator/Installer after installation. Typically, the customer can plan on being without the use of sinks and appliances for a few days.

  • “Field Work” & Potential Delays — The installation of countertops may require “field work” (trimming the countertops) to ensure the best possible fit. This procedure is usually performed in a driveway or other designated area, provided there isn't any inclement weather. As a result of any inclement weather, and in the event the customer doesn't have a covered outside work area, the Certified Fabricator/Installer may have to re-schedule the installation.

DISCLAIMER REGARDING DELIVERY and INSTALLATION

We require our third-party contractors to conduct a background check on any person they hire to enter your home. Countertop installers perform their installation services in accordance with all requirements imposed by state and local authorities, including being licensed and insured, as applicable. They have also undergone a thorough background-screening process before replacing your countertop. As third-party contractors, they are responsible for their behavior and services. However, we ask that you inform us if there are any issues so that we may address with the third party.

WARRANTY STATEMENT FOR PRODUCT(S)

Superior Kitchens and More, Inc or CabinetrySolution.com guarantees that the installation of goods shall be free from defects in workmanship for a period of one (1) year from date of completion.

All warranty claims under the countertop warranty must be directed together with supporting pictures and notes to CabinetrySolution.com by filing a claim on our website or sending an e-mail to

QUARTZ RESIDENTIAL WARRANTY FOR NORTH AMERICA

We provide a Lifetime Limited Warranty that the quartz countertop surfacing product (“the Product”), will be free from manufacturing defects under normal use and service. This non-transferrable warranty covers the Product only and is extended solely to, the original purchaser(s)/ homeowner(s) of the Product who reside in and own the home in which the Product is originally installed by a Certified Fabricator/Installer, (“Owner(s)”) and maintained in accordance with the Quartz Care and Maintenance Guidelines. In addition, this warranty pertains only to interior residential installations within the U.S. and is only valid if the Product and installation has been paid for in full.

 

The Product is made up of natural materials which inherently vary in color, shape, size and distribution within each slab. In addition, some of the Product colors contain movement or veining and variances due to the randomness of this effect are to be expected and are not covered under this warranty.

 

Although the Certified Fabricator / Installer is responsible for carefully inspecting the Product prior to fabrication and installation, it is still the responsibility of the Owner(s) to thoroughly inspect the Product upon receipt and prior to permanent installation.

 

Product failures due to manufacturing defects will be repaired or replaced by CabinetrySolution.com at its discretion. CabinetrySolution.com and its partners will seek to provide the best possible result. However, whether we choose to repair or replace the Product, an exact color match cannot be guaranteed due to different batches in materials fabrication of origin and distributors.

TERMS AND CONDITIONS FOR QUARTZ WARRANTY

This warranty covers only the repair or replacement of the actual section of the material determined to be damaged. Material distributor may choose to inspect the to determine defect or damage.  The Owner(s)’ sole and exclusive remedy against Cabinetry Solution shall be at the sole option of CabinetrySolution.com to repair or replace the defective Product. Cabinetry Solution will make all decisions affecting this warranty and decisions will be final and binding upon all parties.

 

 

    The Product must:

  • Be fabricated and installed by a Cabinetry Solution's recommended Certified Fabricator/Installer

  • Be maintained in accordance with the Quartz Care and Maintenance Guidelines

   

    The Owner(s) must:

  • Be the original purchaser of the Product

  • Own the US residence in which it was originally installed, or have supplied other products and/or services purchased from Cabinetry Solution to the same US residence

  • Provide an original receipt or proof of purchase showing:

  • The Product and installation is paid in full

  • The homeowner(s) of the home in which the material is installed are the original Owner(s) of the Product or have purchased other products and/or services purchased from CabinetrySolution.com to the original Owner(s) of the Product

 

         

    CabinetrySolution.com, its partners and their authorized agents must be permitted sufficient time and opportunity to:

  • Inspect the Product

  • Evaluate the claim

  • Respond to the claim with a solution located in a residential neighborhood is considered Residential.

 

WARRANTY EXCLUSIONS

    This warranty DOES NOT cover:

  • Variance in color, size, shape and particulate distribution from sample, slab and/or final installed countertop.

  • Scratches, while the Product is scratch resistant it is not scratch proof therefore cutting boards are highly recommended.

  • Blemishes are inherent and expected in such natural materials.

  • Minor staining or water spots. While the Product is stain resistant, it is not stain proof, please take care to clean up any spills on your surface as quickly as possible.

  • Normal wear, including but not limited to, scratches, chips, abrasions, and dullness to the finish. Please refer to the Quartz Care and Maintenance guidelines received with your purchase.

  • Supplemental repair including, but not limited to, electrical, tile or wall surfaces, backsplashes, cabinetry, freight, and plumbing modifications necessary to repair or replace the product.

  • Fabrication and installation of product by a provider other than a Cabinetry Solution Quartz Certified Fabricator/Installer

  • Damage resulting from not following CabinetrySolution.com recommended guidelines for storage, handling, supports, cutouts, fabrication, care, and maintenance. All requirements for fabrication and installation must be followed.

  • The securing of any type of mechanical fasteners directly into the material.

  • The appearance or performance of seams, edges, joints, adhesives, caulk and /or other accessory items.

  • The Product failure due to bending or curving, i.e., thermoforming.

  • The Product fabricated or installed outside the United States of America.

  • If the Product is removed from the original place of installation

  • Alteration/repair has been performed on the Product by someone other than a CabinetrySolution.com Certified Quartz Fabricator/Installer.

  • The Product installed in applications such as, but not limited to, shower trays or shower pans, steam showers, steam rooms and saunas.

  • The Product installed as an exterior application and/or exposure to UV.

  • The Product installed as flooring.

  • Chips and cracks caused by impact excessive force, applied load, lack of adequate support, settling or movement of cabinets.

  • Exposure to harsh or corrosive chemicals and cleaners.

  • Exposure to extreme heat and/or thermal shock. Trivets must be used for any hot pots, pans, crock pots, and for any heat generated items. Heat resistant pads are highly recommended.

  • The use of the Product for commercial application(s) including, but not limited to, installation in store, office, rental property, or other places of business.

  • Errors in fabrication or installation, including damage caused to other areas of the home during installation.

  • Damage or injury caused by improper use or abuse, which includes but is not limited to, damage from accidents, vandalism, impact, chemical damage, bleach damage, acts of nature, job-site conditions, architectural design, or structural improvement.

  • Material or services have not been paid in full.

  • Any residence where the Owner(s) is not the occupant.

  • Appearance of edge, re-fabrication, or altering of the factory applied face finish in any way.

  • The Owner(s), decide they do not like the Product after installation due to color, shade, pattern, or any other opinions based on personal preference.

  • Any other items or occurrences that are inherent characteristics of the Product, regardless of whether viewed as a defect by the Owner(s).

Therefore, samples are not meant to be an exact replication of the Product slab or final installed countertop. In addition, some of the Product colors contain movement or veining and due to the randomness of this effect, samples of these colors may not show this overall aesthetic. These variances are to be expected, so please refer to samples only as a general indication of a particular color’s design pattern, aesthetics, and hue when selecting a color. Also be advised the Product samples and slabs may vary from the actual, installed Product surface.

 

No other warranties, express or implied, are made, including merchantability or fitness for a particular purpose. Except as provided herein, CabinetrySolution.com is not liable in tort or contract for any loss or direct, incidental, or consequential damages as a result of the use or the inability to use the Product. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Some states do not allow the exclusion or limitation of implied warranties or of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

 

CabinetrySolution.com makes no other guarantee, representation, or warranty (express or implied) with respect to its products, except as expressly stated herein. No representative, dealer, employee, installer or any other person is authorized or permitted to make, modify or change this warranty with respect to the Product.

 

All parties must agree to comply with the terms and conditions outlined in this Limited Lifetime Warranty.

GRANITE RESIDENTIAL LIMITED LIFETIME WARRANTY FOR NORTH AMERICA

CabinetrySolution.com provides a Lifetime Limited Warranty that its product, Granite treated with Granite Pro (“the Product”), will be guaranteed free from stains or spills from foods and beverages under normal use and service. Granite Pro is the approved sealant by CabinetrySolution.com (“the Approved Sealant”).

 

This non-transferrable warranty covers the Product only and is extended solely to, the original purchaser (s) and homeowner(s) of the Product who reside in and own the home in which the Product is originally installed by a CabinetrySolution.com Certified Fabricator/Installer, (“Owner(s))” and maintained in accordance with the Granite Care and Maintenance Guidelines. In addition, this warranty pertains only to interior residential installations within the U.S. and is only valid if the Product and installation has been paid for in full.

 

The Product is quarried granite material only and is subject to veining and slight variances, including but not limited to: color, shade, particle structure, surface irregularities, texture irregularities, fissures, pits or other variances that occur naturally in the stone. These natural variances are to be expected and are not covered under this warranty.

 

The third party Certified Fabricator/Installer is responsible for carefully inspecting the Product before fabricating and for applying the Approved Sealant to the Product in accordance with the labeling instructions prior to installing the Product. However, it is still the responsibility of the Owner(s) to thoroughly inspect the Product upon receipt and prior to permanent installation.

 

Product failures due to manufacturing defects will be repaired or replaced by CabinetrySolution.com at its discretion. CabinetrySolution.com will seek to provide the best possible result. However, whether we choose to repair or replace the Product, an exact color match cannot be guaranteed.

For declined claims, CabinetrySolution.com will provide an explanation as to the reason for the declined claim. The decision of CabinetrySolution.com shall be final.

 

Multiple claims for the same order will not be accepted without prior approval from CabinetrySolution.com.  

 

We do not provide financial compensation, including partial or full refunds, to remedy any claim, delay or concern. Claims are addressed as outlined above.

4.  MISCELLANEOUS TERMS

  COMMUNICATION LIMITED to PARTY WHO PLACED ORDER​​​

   CabinetrySolution.com can only provide information to, and communicate with, the customer stated on the order. We cannot make commitments to address requests by third parties (including homeowners who have contracted contractors ordering from us).

TYPOGRAPHICAL ERRORS

 

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers,  CabinetrySolution.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. 

CabinetrySolution.com shall have the right to refuse or cancel any orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled at our initiative, CabinetrySolution.com shall immediately issue a credit to your credit card account used in the purchase in the amount of the incorrect price.

We do our best to ensure that all items are as displayed and described as accurately as possible.  CabinetrySolution.com is not responsible for typographical errors or images that may be inaccurate.  If there are any questions about an item, please contact Customer Service.

Warranty does not apply to Product: installed outdoors; used for purposes for which it is not designed or
intended by
CabinetrySolution.com; which has been subjected to misuse, vandalism, abuse, negligence, or accident; which has been improperly stored (if Product must be stored, it should be covered and stored in a humidity/temperature controlled 

environment away from direct sunlight); which has been improperly installed, cleaned or maintained; (vi) which has been

subject to improper temperature and/or humidity extremes (temperature outside the range of 50-85°F, humidity outside the range of 30-55%); exhibiting normal wear and tear; and not purchased in, or installed in the United States.
 

In addition, natural woods may vary in color and characteristics and exhibit subtle changes as the age. For example painted
doors, drawer fronts and/or solid wood panels may eventually have visible cracking around the joint area and cabinet colors
may darken or lighted over time. Sunlight, smoke, and other environmental conditions may also affect the color and integrity
to your finish over time. These variations are considered to be the nature of the material in relation to their environmental
exposure and are not covered under this Warranty.


Certain household cleaners and other substances may also affect the color and integrity of the Product's finish over time. Any
such effects on the color and/or integrity of the finish over time are not covered by this Warranty.

ORDER ACCEPTANCE POLICY

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. CabinetrySolution.com reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.

HOW WE AGREE TO RESOLVE DISPUTES—MANDATORY ARBITRATION OF ALL CLAIMS AND DISPUTES: THIS SECTION PROVIDES IMPORTANT INFORMATION ABOUT BINDING ARBITRATION. UNLESS YOU OPT-OUT OF THIS ARBITRATION AGREEMENT BY E-MAILING  Reply@CabinetrySolution.com WITHIN 30 DAYS OF FIRST PLACING AN ORDER, YOU AND CABINETRYSOLUTION.COM SHALL BE BOUND BY THIS BINDING AGREEMENT TO ARBITRATE ANY CLAIMS, AND GIVE UP ALL RIGHTS TO SEEK RELIEF IN THE COURTS EXCEPT AS PROVIDED HEREIN TO ENFORCE ANY ARBITRATION AWARD. This Agreement also precludes card disputes and efforts to charge back sums paid to CabinetrySolution.com. This Agreement shall be governed by the laws of the State of Florida, and any Conflict of Law provisions thereunder. In the event of any controversy, claim, or dispute between the parties arising out of or relating to this Agreement, the parties agree to resolve all issues solely through the use of binding Arbitration, governed by the rules of the American Arbitration Association (“AAA”) pursuant to the Federal Arbitration Act. Any such Arbitration shall take place within Broward County, Florida or at such other location as the parties may agree, and shall be conducted by a mutually agreed upon Arbitrator. The arbitrator shall be neutral, independent, and shall comply with the AAA code of ethics. The arbitrator or arbitration panel shall have the exclusive and sole authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability of formation of this Agreement and of this arbitration requirement. The award rendered by the Arbitrator shall be final, binding on all parties, but subject to review in accordance with applicable statutes, rules and regulations governing arbitration awards. Judgment on the award made by the Arbitrator may be entered into any court having jurisdiction over the parties. If either party fails to comply with the Arbitrator’s award, the injured party may petition the Circuit Court for enforcement.

 The parties further agree that either party may bring claims against the other only in his/her, or its individual capacity and not as a Plaintiff or class member in any purported class action or representative proceeding. Further, the parties agree that the Arbitrator may not consolidate proceedings of more than one person’s claims, and may not otherwise preside over any form of representative or class proceeding.  Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. In the event that a party fails to proceed with Arbitration, unsuccessfully challenges the Arbitrator’s award, or fails to comply with the Arbitrator’s award, the other party shall be entitled to costs of suit, including reasonable attorneys’ fees for having to compel Arbitration or defend or enforce the award. This section and the arbitration requirement shall survive termination of Services or the Agreement.
